Attorney at Law, Justin Phelps is challenging President Carmona’s right to “refuse” assent on the SSA Act.
President Anthony Carmona said earlier this week that, “In every Bill to be assented, there is always a need or cause for pause…The assenting to Bills can neither be pre-emptive or instanter.” In support of his claims President Carmona cited section 61 (2) of the Constitution. Attorney Phelps counters that Section 61 must be read alongside Section 80 which covers the general provision governing the President’s powers.
Phelps contended that the President witholding assent on a piece of legislation could lead to a constitutional crisis.
