Arima Magistrate, Adrian Darmanie, on Tuesday dismissed all charges against former Hindu Credit Union President Harry Harnarine and two security officers of the HCU Security Company, Ronald Malchan and Elvis Sookoo.
Mr. Harnarine and Malchan were charged ten years ago with participating in a public march without permission from the Commissioner of Police contrary to Section 112 of the Summary Offences Act.
In addition Mr. Harnarnine was charged with organizing the march, and with resisting a police officer in the execution of his duty.
Mr. Malchan was also charged with resisting a police officer in the execution of his duty.
Mr. Sookoo was charged with obstructing the highway.
The trial of the matter took place at the Arima 3RD Magistrates Court over several days after which the Magistrate ordered the Defendants to file written submissions and the State to respond.
The Defendants’ lawyers Scoons Attorneys and Counselors at Law filed their submissions.
The prosecution was represented by senior State Attorney Simone Jaggesar of the DPP’s Office.
The Prosecution did not file any written submissions in response and when Ms. Jagessar appeared before the Magistrate she told the court that having regard to the Defendants’ strong submissions, and advice from the senior lawyers at the DPP’s Office she is not pursuing any conviction in the matter.
