The Highway Re-route Movement (HRM) has lost its battle against the state to have an interim conservatory order to halt work on the controversial Debe to Mon Desir section of the Point Fortin Highway.
However, High Court judge, Justice James Aboud, agreed with the group’s claim that the Government breached their rights by not considering recommendations of the Dr James Armstrong-led Highway Review Committee.
In his 74 page ruling Justice Aboud stated the Government created a legitimate expectation in the minds of members of the HRM when they agreed to review the findings of the Armstrong Committee, but failed to do so and continued with construction of the roadway.
Justice Aboud said he did not agree that an order be granted since the movement took too long to make an application.
This ruling means the Government is now free to continue work in the area.
